Chief Aikin,
I was informed officially by the City Clerk, that
Lt. Stanesa was the person to contact regarding liquor code violation
complaints. She informed me at the direction of Hannah Eisner, who is the Deputy
City Counsel. According to the Mayor, and Hannah, we cannot send these
complaints directly to the Mayor if they have photo evidence attached, as this
would taint their judgement, prior to any official investigation by the
Bloomington Police Department. There seems to be some major finger
pointing going on as to who first requests the investigation, the Liquor
Commissioner, or the police?
And after my conversation with A/C Moser, in early
November 2006, I informed him I had lots of video evidence of liquor code
violations that backup all of the complaints that have been made in writing to
the Hannah Eisner and Mayor Stockton, dating back to August. But, A/C
Moser indicated that the Bloomington Police received hundreds of liquor code
complaints each year, and that "we are not interested in them", and did
really seem to interested when I told him I had a "boat load" of video
evidence. NONE of which has been investigated or reviewed by the police or
liquor commission, despite it being offered in each letter of complaint to
Hannah and/or Mayor, or to Lt. Stanesa, as well as in each email
complaint. A/C Moser only viewed a noise complaint video and one liquor
code compaint. Their were several with me, many on CD rom.
This only begs the question, with so much
overwhelming video evidence offered to backup these compaints, and so many
people doing their very best not to view them or investigate them, or take any
corrective action against this bar, why is everyone shielding this
business? I do not think very many other businesses get this kind of
protection. Most, would likely have their licenses permenantly
suspended. Even the more serious complaints of after hours serving and
drinking have not been investigated. And it has been over a month
and half since the Illinois State Police dropped off the video evidence of the
people coming out of Fat Jacks and going into our alley and vandalizing our
building to the Bloomington Police, and NO ONE from the Bloomington Police have
contacted us regarding this incident? Is it being investigated?

A/C Moser, or myself. Of course you can contact our Mayor, any council
person or the legal department. If you see what you think is a possible
violation of the law, you can also call the dispatch center and we will have
an officer respond. That number is 820-8888.
If you have video or pictures please feel free to forward that
information to the legal department, and if they decide an investigation needs
to be done, they will notify A/C Moser.

How can you say that he was not stumbling, when you have not even
viewed the evidence on the video. You have been sent only static
pictures. You have not even taken the most basic and fundamental steps
of reviewing the video!!!! BULLLSHIT.

public. Unfortunately, with the information provided, there is

While it may appear this person was overserved, what proof do we have of
the that allegation. We certainly do not have a blood alcohol
content reading on the subject. From the pictures you have provided, I do
not observe this subject as stumbling, falling or possessing any other
signs of being overly intoxicated. Unfortunately we can not proceed on
this issue any further.
In saying that, I am in no way making light of the fact that this
individual urinated on your property. I understand that this is
definitely an issue in the downtown area and our officers take a zero
tolerance approach to that activity.

I would like to make a formal liquor code violation complaint
against Fat Jack's 513 N. Main Street. At 12.44 am Friday January
12, 2007 an what appears to be overserved man exited Fat Jack's bar and
eventually crossed N. Main Street to our building and urinated on our
front door. Not only was this eyewitnessed by me, who confronted
the individual, who initially denied doing it, but I was able to summon
a Bloomington Police officer to come a give this person a citation for
public urination.
This person was intoxicated, and they came out of Fat Jacks and
they engaged in a misdermenor crime. This whole indicdent was
captured on video, and some of the still photos taken from the video are
attached to verify as hard evidence that this event happened and should
be investigated. This is person was not the only overtly visibley
overserved individual videoed leaving Fat Jacks this morning.
